The petitioner is apprehending his arrest in connection with Tekari P.S.Case No.204/2018 (G.R.No.3620 of 2018) , registered for offences punishable under Sections 323, 498(A)/34 of the Indian Penal Code.

Allegation against the petitioner is of subjecting his wifeO.P.no.2 of cruelty and not paying amount for her maintenance. Submission of the learned counsel for the petitioner is that he is working in a private firm at Muradabad and he is paying some amount for her maintenance regularly which he has stated in para 7 and he has further stated in para 8 that she is residing in her Sasural and he is ready to keep her and pay maintenance to her.

Patna High Court CR. MISC. No.18938 of 2019(4) dt.19-06-2019 2/2 Heard learned A.P.P. and the learned counsel for the O.P.no.2. They have opposed the prayer for bail on the ground that the petitioner is torturing her and not paying any expenses to her and she has daughters also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below on 1.7.2019 and file an undertaking that he will pay regularly Rs.03,000/- (Three Thousand) per month in the bank account of the O.P.no.2 till any order is passed by any competent court in this regard, he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-VI, Gaya in connection with Tekari P.S.Case No.204 of 2018 (G.R.No.3620 of 2018) subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is disposed of.
