The petitioner seeks bail in a case instituted under Sections 395 of the Indian Penal Code.

The allegation against the petitioner is that he was caught with looted tanker.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with the observation "at this stage".

In the light of the observation made in the earlier order, the present application has been preferred on behalf of the petitioner.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.37098 of 2016 (3) dt.26-10-2016 2/2 the petitioner is in custody since 07.08.2015. He has remained in custody for more than a year. He is not named in the First Information Report. He has not been put on Test Identification Parade.

On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Piprakothi P.S. Case No. 72 of 2015.
