1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioner apprehends his arrest in connection with Sono P.S. Case No.276 of 2025 instituted under Section 331(4) & 305(a) of the B.N.S., 2023.

3. As per the prosecution case, the petitioner alongwith co-accused person have committed theft in the dwelling house of informant stealing household items including one T.V. which has been sold by the petitioner and other coaccused to one Ahmad Ansari.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. He further submits that there

Learned counsel submits that recovery of T.V. is made from the co-accused Ahmad Ansari with whom the informant had compromised. He further submits that there is no material against the petitioner to implicate him in the present occurrence. Learned counsel submits that other co-accused persons, namely, Ahmad Ansari and Pawan Kumar @ Pawan Kumar Das have been granted anticipatory bail by the Coordinate Benches of this Court vide orders dated 12.03.2026 & 21.04.2026 passed in Cr. Misc. No.14465 of 2026 & Cr. Misc. No.6344 of 2026 respectively. He further submits that petitioner has got clean antecedent and he undertakes to cooperate in the investigation and trial of the case.

5. Learned A.P.P. for the State and learned counsel for the informant opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case, submissions of learned counsel for the parties, the nature of allegation leveled against the petitioner and his clean antecedent as well as the fact that similarly situated co-accused persons have already been granted anticipatory bail, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing

Patna High Court CR. MISC. No.21923 of 2026(5) dt.24-06-2026 3/3 bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Court of Additional Chief Judicial Magistrate-II, Jamui/ concerned Court in connection with Sono P.S.
