Petitioners apprehend arrest in connection with Madhepura (Ghailadh) P.S. Case No. 58 of 2015 registered under Sections- 304B, 201/34 of the Indian Penal Code. The allegation against the petitioners is of torture and assault to the daughter of the informant due to nonfulfillment of demand of dowry. Ultimately she was done to death by setting her on fire and her dead body was cremated in haste to make the evidence disappear.

Learned counsel for the petitioners submits that petitioner no. 1 is Gotni and petitioner no. 2 is the mother-inlaw of the deceased. Petitioners are separate in mess and

Patna High Court Cr.Misc. No.3463 of 2017 (2) dt.14-02-2017 2/2 residence. In his deposition, informant has stated that deceased died due to pain in her stomach, and therefore, there is no question of her killing. There is no specific allegation against the petitioners.

Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District & Sessions Judge, Madhepura in connection with S.T. No. 185 of 2015 arising out of Madhepura (Ghailadh) P.S. Case No. 58 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
