JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 506, 34 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 19.11.2021 and has antecedent of one case but inadvertently at Para-3, it has been recorded that he has antecedent of two cases though only one case is mentioned and the informant alleges that on account of dispute relating to children the accused persons including the petitioner assaulted the victim as informed by his daughter leading to his death. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is

No.20239 of 2022(3) dt.06-01-2023 2/2 next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the allegation of assault is general and omnibus in nature. It is next submitted that the charge-sheet has been submitted and the petitioner undertakes to cooperate in the trial.
Learned A.P.P. opposes the bail application.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Obra P. S. Case No.249 of 2021.
The application stands allowed.
