The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504 and 506/34 of the Indian Penal Code.
It is alleged that the accused persons including the petitioners came and asked the informant to withdraw the case lodged against them and thereafter assaulted
Patna High Court Cr.Misc. No.34615 of 2015 (2) dt.25-08-2015 2/3 the informant. It is specifically alleged that petitioner Bikram Yadav caught hold the informant, petitioner Mantu Yadav assaulted with iron rod whereas petitioner Fantush Yadav snatched gold chain.
It is submitted by learned counsel for the petitioners that the accusation has been levelled in the background of litigated relationship between the parties. Though, informant side earlier also lodged a case under the bailable provisions of the IPC against the petitioners, but much prior to that mother of the petitioners lodged Harpur P.S. Case No. 24 of 2014 against the informant side levelling accusation under Sections 341, 323, 504/34 of the IPC and except the case lodged by the informant side no other case is pending against the petitioners.
Considering the accusation in the background of litigated relationship between the parties, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Harpur P.S. Case No.
Patna High Court Cr.Misc. No.34615 of 2015 (2) dt.25-08-2015 3/3 31 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
