The petitioner seeks bail in a case registered for the offences punishable under Section 387 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 02.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.
The learned counsel for the petitioner submits that the informant alleges that he received extortion call from mobile no.8272996242 and the caller demanded extortion of Rs. Ten lacs and threatened to kill. Further a message also came on his mobile from the same mobile number asking for extortion.

It is submitted that Praduman Kumar, who is cousin brother of the petitioner was working in the hotel of the informant and he had some issues regarding salary dues on account of which, the present false case came to be instituted. It is submitted that the present petitioner had come to meet Praduman Kumar (his brother) when the informant very wisely took his mobile and made the aforesaid call and also sent a message on his whatsapp.
The learned counsel further submits that it absolutely does not stand to reason that an accused from his own mobile would make an extortion call and would also send a message, who thus, create evidence against himself and get implicated. It is further submitted that co-accused Praduman Kumar has been granted bail by order dated 26.04.2022 in Cr. Misc. No.69905 of 2021.
Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and co-accused has been granted bail and taking into consideration the submissions made by the learned

No.20605 of 2022(2) dt.28-04-2022 3/3 counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajgir P. S. Case No.327 of 2021.
The application stands allowed.
