The petitioner apprehends his arrest in Baghaila P.S. Case No. 18 of 2016 instituted for the offence under Section 379 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that besides suspicion, there is no allegation of any overt act against this petitioner. In the written report itself it appears that informant has merely raised suspicion that petitioner might have committed theft of buffalo. It is mentioned in para-3 of the bail petition that petitioner is a man of clean antecedent.
Patna High Court Cr.Misc. No.3156 of 2017 (2) dt.02-02-2017 2/2 In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Baghaila P.S. Case No. 18 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) Cr.P.C.
