The petitioner seeks bail in a case registered under Sections 370, 370A, 120B/34 of the Indian Penal Code and 3/4/5/6/7 of the Immoral Traffic (Prevention) Act, 1956. The prosecution case in brief is that house of one Sanjay Kumar was raided and when the door was opened, three women and three men were found in compromising situation. The smell of liquor was also coming from the mouth of three men. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 11-01-2019. Charge sheet has

Patna High Court CR. MISC. No.19225 of 2019(3) dt.03-05-2019 2/2 already been submitted. The petitioner has been falsely implicated in the present case. There is no other substantive evidence to suggest the implication of the petitioner in the present case. The other co-accused with similar allegation have been granted bail by coordinate benches of this court vide orders dated 02-04-2019 passed in Cr. Misc. Nos. 18161 of 2019 and 20280 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Jogsar) P.S. Case No. 23 of 2019.
