The petitioner seeks bail in a case instituted under Sections 364, 120(B)/34, 302 and 201 of the Indian Penal Code. The prosecution case, in brief, is that the husband of the informant was kidnapped by co-accused Manoj Kumar Mehta by a white colour vehicle and fled away. It has further been alleged that the informant has suspicion that the petitioner was also involved in the said crime along with other co-accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.06.2 016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.33611 of 2016 (3) dt.28-09-2016 2/2 witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. His name has come in the confessional statement of co-accused. The other co-accused has been granted bail vide Annexure-3 to the present application. On behalf of the state it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhepura, in connection with Srinagar P.S. Case No. 21 of 2015, G.R. No. 552 of 2015.
