3. Learned counsel submits that with filing of the original petition, the defects has been removed.

4. Heard learned counsel for the petitioner and Mr. Suman Kumar Jha, learned AC to AAG-3 for the State.

5. Learned counsel for the petitioner submits that during pendency of the writ application the suspension of the petitioner has been revoked in the month of December, 2022. Now the only grievance of the petitioner is that he has not been paid his subsistence allowance during the period of suspension.

6. Learned counsel for the State submits that since the petitioner did not submit his joining at the Headquarter to

Patna High Court CWJC No.5444 of 2022(2) dt.27-04-2023 2/2 remove the suspension period, therefore, vide district order 923 of 2020, the subsistence allowance of the petitioner was withheld.

7. Learned counsel for the petitioner submits that he has filed an appeal before the Deputy Inspector General of Police, Begusarai Range vide Annexure '5' to the writ application which is pending consideration.

In the given facts and circumstances of the case, this Court directs the Deputy Inspector General of Police, Begusarai Range (respondent no. 2) to consider the representation of the petitioner as regards his prayer for grant of subsistence allowance and pass a reasoned order thereon within a period of two months from the date of receipt/production of a copy of this order.

This writ application stands disposed of accordingly.
