Petitioner prays for bail in connection with Falka P.S.Case No. 319 of 2017 registered for the offences punishable under Sections 387, 307 and 34 of the Indian Penal Code. Allegation against the petitioner is of firing on the brother of informant and causing injury to his abdomen. Submission of learned counsel for the petitioner is that firing was not intentional and he is in custody since 28.12.2017. Heard learned APP also, who has opposed the prayer for bail. From perusal of impugned order it appears that injury caused is dangerous to life and allegation against the petitioner is of firing.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.58081 of 2018 (2) dt.08-10-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner.

However, since the petitioner is in custody for 10 months, learned trial court is directed to expedite the trial. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U T
