JUSTICE ALOK KUMAR SINHA ORAL ORDER 17-04-2025 The learned counsel for the petitioner submits that for seeking the same relief as prayed for in the present writ application, the petitioner has already approached the District Magistrate-cum-Collector, Banka by filing a representation on 13.02.2024 which is still pending and has not been disposed of by the District Magistrate. The petitioner further submits that he would be satisfied if an appropriate direction is given to the respondent no. 4- District Magistrate-cum-Collector, Banka to dispose of his representation after giving an opportunity of hearing to the petitioner.

2. The learned counsel appearing for the State has made no objection.

3. In view of the above, the District Magistrate-cumCollector, Banka is hereby directed to dispose of the representation filed by the petitioner on 13.02.2024 (Annexure3 series) at page 15 of the writ application within three months from the date of production of a copy of this order.

4. While disposing of the said representation, the District Magistrate-cum-Collector, Banka shall grant opportunity of hearing to the petitioner and he shall pass a reasoned and speaking order in accordance with law.

5. The petitioner is granted liberty to make prayer for the interim relief before the District Magistrate-cum-Collector, Banka who will consider the same in accordance with law.
