JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.

There is specific allegation against the petitioner that he opened fire, causing firearm injury on the hands of the informant and, therefore, I am not inclined to release him on bail, at this stage. Hence, his prayer for bail in connection with Bihta P.S. Case No. 619 of 2015, pending in the Court of Additional Chief Judicial Magistrate, Danapur, Patna stands rejected. However, the petitioner may renew his prayer for bail, after framing of the charge.
