Petitioner seeks bail in connection with Majorganj P.S. Case No. 39 of 2017 registered for the offence punishable under sections 420, 409, 467, 468 and 471/34 of the Indian Penal Code and Section 7 of the Essential Commodity Act. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is neither store incharge nor holding any administrative post and he is merely a clerk assigned with doing account work after his retirement. Audit team had audited the account of the Bihar State Food and Civil Supplies Corporation Limited, Sitamarhi and found that the petitioner has not
Patna High Court Cr.Misc. No.60987 of 2018(2) dt.06-10-2018 2/2 committed any sort of financial irregularity, defalcation or causing loss to the Corporation (Annexure-4). Petitioner is in custody since 23.07.2018.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Sitamarhi in connection with Majorganj P.S. Case No. 39 of 2017.
