Petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

The FIR of the occurrence of dacoity is against unknown. Petitioner is in custody since 24.05.2018. Submission is that the petitioner was never put on Test Identification Parade during investigation of the case nor any incriminating article has been recovered. Only material is suspicion.

Considering the aforesaid submission as well as the fact that some other co-accused has been allowed bail by a Coordinate Bench of this Court vide order dated 23.07.2018 passed in Cr. Misc. No. 33598 of 2018, let the petitioner, above

Patna High Court CR. MISC. No.18614 of 2019(2) dt.01-05-2019 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 516 of 2018 arising out of Gandhi Maidan Police Station Case No. 73 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
