JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-09-2015 Heard learned counsel for the petitioners, learned counsel for the informant and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code. It is alleged that petitioner no. 2 namely Gaurav Pandey assaulted with iron rod on the head of the informant. When father of the informant and Ramanand Sao came to rescue them they were assaulted by petitioner no. 1 namely Bindu Pandey. It is also alleged that accused persons also assaulted the family members of the informant. Co-accused Saurav Pandey took away gold chain of the informant.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.36326 of 2015 (2) dt.08-09-2015 petitioners that all the injuries received by the informant's side are simple in nature. One injury of Renu Devi is grievous but there is no specific accusation of assault to assault by the petitioners. There is counter version of the occurrence. Petitioner no.1 received grievous injury.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 32 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
