JUSTICE SUDHIR SINGH ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner is to have tortured and killed sister of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that he is in custody since 1.10.2014. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case. The independent witnesses have been examined at paras-19 and 21 of the case diary. It has been stated by the independent witnesses that while cooking the deceased caught fire, she was taken to the hospital and in course of treatment she died. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.29224 of 2016 (3) dt.01-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-9th , Gaya , in connection with Tekari ( Panchanpur) P.S. Case no. 230 of 2012.
