JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Nautan P.S.Case No.194/16 for the offences under Sections 341, 323, 504 and 384/34 of the I.P.C.

The allegation against the petitioners is of abusing and assaulting the fufera brother of the informant with fists and

Submission of the petitioners is that there is long standing land dispute between the parties. There is case and counter case. He further submits that the case diary does not whisper anything regarding extortion against the petitioners. The case diary also does not reveal any criminal antecedent against the petitioners. There is no injury report in the case diary. Considering the aforesaid facts and circumstances and nature of allegation, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M.,-VI, Bettiah, West Champaran, in Nautan P.S.Case No.194/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C..
