The petitioner seeks bail in Gopalganj P.S. Case No. 207/2016, instituted for the offences under Section 302/34 of the Indian Penal Code read with Section 27 of Arms Act. Earlier prayer for bail of the petitioner was rejected on the ground that petitioner is main assailant of this case vide order dated 27.01.2017 passed in Cr. Misc. No. 50338/2016. The Court below has mentioned in the impugned order that one of the witness, namely, Neyaz Ali has been examined in this case who has levelled allegation against this petitioner of causing firearm injury on the back of husband of informant.

Patna High Court Cr.Misc. No.60147 of 2018 (2) dt.03-10-2018 2/2 In view of such, this Court does not find any merit in this bail petition. Accordingly, prayer for bail of the petitioner is rejected.

Learned counsel for the petitioner has submitted that petitioner is in custody since 07.06.2016.

The court below is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of copy of this order.
