The petitioner is languishing in custody since 11.10.2015 in a case registered for the offences punishable under Sections 20, 22, 23 and 29 of NDPS Act.

The petitioner was intercepted while travelling on a motorcycle and from a bag 1 kg. 970 grams. Charas were recovered.

It is submitted by learned counsel for the petitioner that on suspicion the petitioner has been roped in the present case and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.32960 of 2016 (2) dt.16-08-2016 2/2 Considering the commercial quantity of recovery of the contraband coupled with the embargo under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner in connection with Balmiki Nagar P.S. Case No. 68 of 2015 (Trial No. 01 of 2016 pending in the court of learned 2nd Additional Sessions Judge, West Champaran at Bettiah. Accordingly, the prayer for bail of the petitioner is rejected.

Let the trial be expedited.
