Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 225, 353, 307, 332, 333, 504, 506 of the Indian Penal Code.
It is alleged that when the police went to arrest the petitioner in Hassanpur P.S. Case No. 6 of 2013, the petitioner was arrested on chase but in the meantime the petitioner and his father Jugeshwar Ram attacked on the police personnel and thereafter a mob of 200 people gathered and made assault when constable Shailendra Kumar sustained injuries. It is further alleged that petitioner snatched the wrist watch of constable Shailendra Kumar.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.33516 of 2015 (2) dt.28-08-2015 2/2 petitioner that in Hassanpur P.S. Case No. 6 of 2013 the petitioner was not sent up for trial and final form was submitted. Moreover no injury report of any constable is on the record.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Pusa P.S. Case No. 06 of 2013, pending in the Court of learned Judicial Magistrate, 1st Class, Samastipur.
Accordingly the application is disposed of.
