JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 376, 120(B) of the Indian Penal Code. The victim made allegation that the petitioner on the pretext of marriage with her, established physical relationship and when she became pregnant, the petitioner refused to marry with her.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.05.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. From perusal of paras 15,16 and 18
Patna High Court Cr.Misc. No.30967 of 2016 (3) dt.21-09-2016 2/2 of the case diary it is evident that there was love affairs between the petitioner and the victim. It is further submitted that the petitioner may be released after completion of nine months in custody from 29.05.2016.
On behalf of the State, it is submitted that the petitioner is named in the FIR and has refused to marry with the victim. Considering the aforesaid facts and circumstances of the case, let, above named petitioner, after completion of nine months in custody from 29.05.2016, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Benipatti (District- Madhubani) in connection with Khirhar P.S.Case No. 11 of 2016.
