The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304/34 of the Indian Penal Code.
Prosecution case in brief is that on the alleged date and time of occurrence, informant along with her daughter reached at Samarpan Seva Sadan for treatment and deposited Rs. 12,000/- and was asked to deposit further Rs. 50,000/- for treatment. Due to non-deposit of the said amount of Rs. 50,000/-, they did not treat properly the daughter of informant, as a result of which daughter of informant died. It is submitted that petitioner is caretaker of
Patna High Court CR. MISC. No.22253 of 2023(2) dt.06-07-2023 2/2 Samarpan Seva Sadan and he has been falsely implicated in this case. Petitioner did not operate the daughter of informant. It is further submitted that daughter of the informant died due to consumption of abortion pill and not due to carelessness and negligence of doctor. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 681 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
