JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Alauli P.S. Case No. 267 of 2016 registered under Sections 363, 366(A), 34 of the Indian Penal Code. The accusation is of kidnapping of minor daughter of informant by co-accused Vivek Kumar for the purpose of marriage. Further allegation of the informant is that in the kidnapping of his minor daughter, the mother, father and brother of co-accused Vivek Kumar also helped.

Learned counsel appearing on behalf of the petitioners submits that in fact Vivek Kumar who is son of

No.2495 of 2017 (2) dt.03-03-2017 2/2 petitioner Nos. 1 and 2 and brother of petitioner No. 3 has left the village with the daughter of the informant and petitioners have falsely been implicated in the present case since they are parents and brother of the co-accused Vivek Kumar.

Having considered the facts and circumstances of the case, let the petitioners above named, be released on anticipatory bail, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 267 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
