The petitioner seeks bail in connection with Shastri Nagar P.S. Case No. 343 of 2017 dated 21.06.2017 registered for the offence punishable under Sections 354 D of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

The allegation against the petitioner is that he used to make lewd comments on the informant-victim and her friends in the way to school. It is further alleged that petitioner snatched the bicycle of the informant and when she and her friends opposed, he abused them and threatened to make viral their photographs on Whatsapp.

Petitioner has a shop and he sells milk, kurkure and other products and when the informant took a packet of kurkure and started carrying the same without paying it, she was stopped and she started to raise hue and cry.

Learned counsel for the petitioner further submits that petitioner is in jail custody since 08.02.2023, having no criminal antecedent. After completion of investigation, charge sheet has already been filed and there is no chance of tampering with the evidence.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Patna in connection with Special No. 102/2017, arising out of Shastri Nagar P.S. Case No. 343 of 2017, subject to the following conditions:-

(ii) In case of absence on two consecutive dates without sufficient reason or if the petitioner misuse the liberty or violate any of the conditions imposed upon him his bail bond will be liable to be cancelled by the Court concerned. (Sunil Dutta Mishra, J) Anand Kr.
