2. The petitioners seek bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 103(1), 352 and 351(2) of the B.N.S..
3. As per prosecution case, due to previous enmity, all the F.I.R. named accused persons, including these petitioners, armed with weapons, came at the door of informant and started abusing husband of informant and whereafter on the order of coaccused Shiv Kumar Das, all the accused persons assaulted
Patna High Court CR. MISC. No.20868 of 2026(2) dt.01-05-2026 2/3 husband of informant with knife and iron rod due to which he fell down and on way to hospital, he died.
4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that there is absolutely no allegation of assault or any other overt act against Petitioner No. 1 and Petitioner No. 2 is only alleged to be waving pistol and threatening nearby people. Specific accusation of assault is against other co-accused persons. Moreover, charge-sheet has already been submitted and petitioners are in custody since 17.12.2025.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and period of custody, the prayer for grant of bail to the petitioners is allowed.
7. Accordingly, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in
