JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner and the State. The petitioner being the husband of the informant is languishing in jail since 08.06.2016 in a case registered for the offences punishable under Sections 341, 323, 406, 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant. Since initially the informant deserted the petitioner in spite of effort being made by the petitioner for resuming the conjugal life, the petitioner file Matrimonial Suit No. 161 of 2016 with prayer for
Patna High Court Cr.Misc. No.30865 of 2016 (2) dt.26-07-2016 2/2 divorce. The investigation has already been concluded and final report has been submitted under Sections 498A and 494/34 of the IPC.
Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, East Champaran, in connection with Mahila P.S. Case No. 87 of 2015.
