====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 27-03-2017 This case has been listed under the heading "To Be Mentioned" at the instance of the learned counsel for the petitioners.
It appears that vide order dated 03.03.2017 passed by this Court, both the above named petitioners were directed to be released on bail, in the event of their arrest or surrender before the learned court below within a period of four weeks from that date, on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No.757 of 2016, subject to the conditions as laid down under
Patna High Court Cr.Misc. No.2508 of 2017 (3) dt.27-03-2017 2/3 Section 438(2) of the Code of Criminal Procedure but, in advertently, in the cause title of the aforesaid order dated 03.03.2017, the name of the father of the petitioner no.1, in place of "Late Arjun Yadav" , "Late Mahesh Yadav" has been typed. It also appears that while the name of the father of the petitioner no.2 has not been given in the application but the same has, in advertently, been typed in the cause title of the aforesaid order dated 03.03.2017 passed by this Court as "Late Arjun Yadav". So far as the address of the petitioner no.1 is concerned, the same has wrongly been mentioned as "resident of village-Mahmanna, P.S. Tekari, District-Gaya", while both the petitioners are the resident of Mohalla-Babutola, Police Station-Banka, District-Banka. It also appears from the operative portion of the order dated 03.03.2017 that the name of the concerned police station has been typed as "Bankia" in place of "Banka".
In that view of the matter, let in the cause title of the aforesaid order dated 03.03.2017 passed by this Court, the name of the father of the petitioner no.1 be read as "Late Arjun Yadav" in place of "Late Mahesh Yadav", the name of the father of the petitioner no.2, as wrongly mentioned as "Late Arjun Yadav" and the address of the petitioner no.1, as wrongly mentioned as "resident of village-Mahmanna, P.S. Tekari, District-Gaya", be
Patna High Court Cr.Misc. No.2508 of 2017 (3) dt.27-03-2017 3/3 deleted and the address of both the petitioners be read as " resident of Mohalla-Babutola, Police Station-Banka, District-Banka, and in the operative portion of the order dated 03.03.2017 passed by this Court, the name of the concerned police station be read as "Banka" in place of "Bankia".
The date of surrender of the petitioners in the court below is also extended for a further period of four weeks from today.
The order dated 03.03.2017 passed by this Court is modified to the aforesaid extent only.
