Petitioner prays for bail in connection with Gaighat P.S.Case No. 89 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 302 and 380 of the Indian Penal Code.

Allegation against the petitioner and one co-accused is of stabbing the deceased and causing his death.

Submission of learned counsel for the petitioner is that allegation of stabbing and causing death of the deceased is against Tarun Kumar, who has been granted bail by the court below and post mortem (Annexure-2) shows no injury of sharp cutting weapon on the person of deceased and further petitioner is in custody since 11.4.2018.

Patna High Court Cr.Misc. No.57830 of 2018 (2) dt.28-09-2018 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail stating that post mortem report has been procured, whereas in inquest report knife injury was found on the person of deceased.

Having heard both sides and in the facts and circumstances and also considering the fact that charge sheet in this case has been submitted, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Muzaffarpur, in connection with Gaighat P.S.Case No. 89 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
