JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 31.5.2016 for the offences punishable under Sections 372, 328, 376, 506, 34 of the Indian Penal Code and 12 POCSO Act, 2012.

The accusation of rape is against co-accused Anwarul @ Dilawar and so far as petitioner is concerned, he happens to be the brother of Anwarul @ Dilawar and there is only allegation against him that he along with his other family members ousted the informant from their house.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with
