The petitioner seeks bail in a case registered for offences under Section 30(a)(b)(c), 38 and 41 (a) (b) of Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 20.7 litres of foreign liquor was recovered from the Scorpio vehicle which was being boarded by three persons including the petitioner. It is contended that the petitioner has no concern with the alleged illicit liquor. It is further contended that nothing has been recovered from the conscious possession of the petitioner. It is

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-II-cumSpecial Judge, Excise Act, Gopalganj in connection with Kuchaikote P.S. Case No. 239 of 2018 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
