The petitioner is apprehending his arrest in connection with Siwaipatti P.S.Case No.13/19 date 15.1.2019 registered for offences punishable under Sections 341, 323, 326, 354/34 of the Indian Penal Code.
Prosecution story is that while the informant was returning after collecting admit card by cycle, the petitioner and other accused persons came on two motorcycles and pulled her dupatta and when she protested, they assaulted her by fists and slaps and there is also allegation against one of the co-accused that he threw petrol on her and the villagers assembled there due to which her life was saved.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case as the writer of
Patna High Court CR. MISC. No.20590 of 2019(3) dt.13-05-2019 2/2 the written statement of the victim has inimical relation with the petitioner.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move for regular bail, which will be considered by the learned court below on its own merit.
With the aforesaid direction, this application is dismissed.
