2. The petitioners apprehend their arrest in a case registered for the offence under Sections 103(1), 61(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. The case of the prosecution is that the informant was married to Amroj Alam and due to dispute, Amroj Alam and informant were living separately from rest of the family. It is alleged that two days prior to the occurrence, Ali Ahmad (petitioner no. 1 in Cr.Misc. No. 19353/25) had threatened that he would kill them. It is further alleged that on 21.08.2024 at 7:30 PM, somebody called husband of informant to come outside the house and her husband went outside the house by saying that he would come in five minutes, but he did not return. The informant suspects that all the F.I.R. named accused persons including petitioners (in both cases), conspiring with each other, killed her husband.

4. Learned counsel for the petitioners in both cases submits that petitioners are none else but close family members of the deceased. Petitioner no. 1 (in Cr.Misc. No. 19353/25) is maternal uncle of deceased, whereas petitioners (in Cr.Misc. No. 19575/25) are mother and father respectively of deceased and it is highly improbable that they would kill their own son. From perusal of F.I.R., it is apparent that only suspicion has been raised against petitioners and except suspicion, there is no other material to support the allegation made in the F.I.R. Co-accused Md. Imdadulla has been granted regular bail by a coordinate

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners (in both cases), in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Raniganj P.S. Case No. 383 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
