JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 201, 120B and 34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons killed sister of the informant and threw her dead body in the well.
It has been submitted on behalf of the petitioner that he is in custody since 2.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is said to be 70 years old man. He is separate in mess and property from deceased. No specific allegation has been made against him. No specific injury has been attributed against him. He is father-in-law of the deceased. On behalf of the State, it is submitted that petitioner is named in the F.I.R. In para-24 of the case diary, son of the deceased has stated that all the accused persons had assaulted the deceased with fists and slaps.
Considering the aforesaid facts and circumstances of the
Patna High Court Cr.Misc. No.32461 of 2016 (3) dt.20-09-2016 2/2 case and the age of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, DistrictArwal, in connection with Karpi P.S.
