The petitioners seek bail in Special P.S. Case No. 87 of 2018 arising out of Dhanarua P.S. Case No. 154 of 2018 instituted for the offence under Sections 341, 363, 504 of Indian Penal Code and Section 12 of POCSO Act.

Counsel for the petitioner submits that petitioner is alleged to be driver of the Bolero vehicle.

In the written report it is alleged that petitioners and other accused persons have been apprehended by the police on the noise raised by the informant while she was taken by the accused persons by Bolero vehicle.

The victim girl has given statement under Section 164

Patna High Court Cr.Misc. No.59534 of 2018 (2) dt.06-10-2018 2/2 Cr. P.C. which has been enclosed as Annexure-2 wherein she has not taken the name of petitioner. She has stated that she knew Vikas. Vikas told her to stop but she did not stop. Thereafter, the accused person forcibly dragged her in Bolero vehicle. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge-1st-cum-Special Judge, POCSO, Patna in connection with Special P.S. Case No. 87 of 2018 arising out of Dhanarua P.S. Case No. 154 of 2018, subject to the condition that both the bailors will be close relatives of the petitioners. (Sanjay Priya, J) S.Ali/- U T
