The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that co-accused Umesh Singh, his wife Puja Devi and the petitioner came on the roof of the house of the informant and assaulted the daughter of the informant Puja Kumari with iron rod, stone and bricks as a result Puja Kumari succumbed to the injuries. It is submitted by learned counsel for the petitioner that due to land dispute the accusation has been levelled and the victim fell from the roof while playing and

Patna High Court Cr.Misc. No.34988 of 2015 (2) dt.18-08-2915 2/2 received injury. It is further submitted that similarly situated Puja Devi has been granted regular bail vide Cr. Misc. No. 11600 of 2015.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Maner P.S. Case No. 533 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Danapur, Patna.

With the aforesaid observation, this application is disposed of.
