2. The petitioner has preferred this application for grant of regular bail in connection with Bishanpur P.S. Case No. 113 of 2024 dated 16.10.2024 registered for the offences punishable u/ss 103(1) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, when the informant was returning home from her filed then she saw the petitioner and the co-accused persons were assaulting her husband. It is further alleged that the petitioner was assaulting the informant's husband on his stomach with iron fighter and the other co-accused persons caught hold of her husband. Thereafter, the informant's husband became unconscious then all the accused persons fled away from the spot. The informant's husband was taken to the hospital where he died during the course of treatment.

4. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.18554 of 2025(3) dt.09-07-2025 2/2 the petitioner is innocent and has falsely been implicated in this case. It is further submitted that both the parties are agnates. Nothing has been recovered from the conscious possession of the petitioner. The petitioner have no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.10.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the specific allegation is against the petitioner that he assaulted the informant's husband on his stomach causing injury to him and thereafter he died during the course of treatment. As per the post-mortem report of the deceased, the cause of death is due to septicemia, toxemia and shock caused by hard and blunt object.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner above-named on bail.

7. The application stands rejected.
