====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sessions Trial No. 731 of 2014 arising out of Chiraiya P.S. Case No. 266 of 2012 lodged under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that in this case petitioner was granted bail but he could not present himself for framing of charge and his bail bond was cancelled, subsequently petitioner was remanded in the present case on 28.07.2021 and since then he is in custody. Learned counsel for the petitioner is not in a position to inform this Court that whether charge has been framed against petitioner in this case or

Learned counsel for the State opposes the prayer for bail and submits that such type of accused may not be released till trial is concluded.

Considering the facts and circumstances of this case and the submissions made above, let the petitioner above named, be released on bail only after framing of charge to the satisfaction of the learned Trial Court.

The petitioner is directed to present himself before the Trial Court on each and every date fixed in this case, otherwise his bail shall be subject to cancellation.

With this observation, the bail application is disposed of.
