JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-12-2025 Despite the valid service of notice, the opposite party no. 2 did not choose to appear whereas learned counsel for the petitioner as well as learned APP for the State are in appearance.

2. The petitioner apprehends his arrest in connection with Sitamarhi P.S. Case No. 70 of 2023, registered for the offences punishable under Sections 406, 420, 467, 468 & 471 of the IPC.

The prosecution case in short is that the informant submitted a written application to the police on 01.02.2023 alleging that on 13.04.2021, the petitioner and co-accused Shaheen Praveen visited his jewellery shop on the pretext of purchasing ornaments. It is alleged that she purchased ornaments worth Rs. 14,56,700/- and handed over three cheques bearing the joint signatures of the petitioner and co-accused Praveen Ara. Subsequently, co-accused Shaheen Praveen requested the informant not to deposit the cheques

4. Learned counsel for the petitioner has submitted that the cheque alleged to have been issued was not presented before the bank and was not dishonoured. It is a money dispute between the parties. The petitioner did not purchase the ornaments from the shop of the informant. He has further submitted that co-accused Praveen Ara has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 73129 of 2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Sitamarhi P.S. Case No. 70 of 2023, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
