JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of Excise Act.

Twenty litres mahua liquor are said to have been recovered from the house of the petitioner for which petitioner is in jail custody since 23.06.2016.

Submission on behalf of the petitioner is that the socalled recovery has not been made in presence of the petitioner and as a matter of fact, he has been implicated in this case at the behest of his enemies.

Considering the aforesaid facts and circumstances as

No.36961 of 2016 (2) dt.01-09-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 154 of 2016.
