Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This application, for grant of anticipatory bail, arises out of Kesariya P.S. Case No. 223/18, disclosing offences under Sections 420 of the Indian Penal Code.

Allegation against the petitioner is that he on the pretext of purchasing the tractor of the informant took the same to the mechanic for examining the vehilce and, thereafter, he did not return the vehicle and asked the informant on phone to give Rs 25,000/- to get the truck.

Submission of learned counsel for the petitioner is that earlier the informant has taken Rs. 25,000/- from the petitioner, which he was not returning and due to which, the truck of the informant was with the petitioner, which will appear from the fact that there is delay of more than two and half months in lodging the F.I.R.

Patna High Court CR. MISC. No.18153 of 2019(2) dt.03-04-2019 2/2 Learned counsel for the State opposed the prayer for bail and submitted that the petitioner is accused in one more case.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of pre arrest bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below and pray for regular bail and show that he has earlier paid the money to the informant and the court below after verifying the said fact shall dispose of the application of the petitioner, if possible on same day, without being prejudiced by the order of this Court.
