Petitioner seeks bail in Chhatapur P.S. Case No.200 of 2019 registered under Sections 379 and 411 of the IPC. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of the coaccused. The police made requisition for remand of the petitioner on 13.08.2019 but the petitioner was remanded only on 10.02.2020 and since then the petitioner is in jail. Nothing has been recovered from possession of the petitioner and stolen motorcycle is said to have been recovered from possession of the petitioner but the same is not the subject matter of the present case. The petitioner is in jail since 10.02.2020. Learned A.P.P., however, opposed the prayer for bail
Patna High Court CR. MISC. No.18826 of 2020(2) dt.09-06-2020 2/2 and submitted that the petitioner has got criminal antecedent and he is an accused in other cases of similar nature. It appears that the informant lodged the case against unknown for theft of his motorcycle bearing registration no.BR50J-9718. During course of investigation, the petitioner was arrested in another case and he is said to have confessed his guilt. The petitioner is remanded in this case but it is submitted that nothing has been recovered from possession of the petitioner.
Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. VI, Supaul in connection with Chhatapur P.S. Case No.200 of 2019. (Prabhat Kumar Jha, J) Harish/- U T
