ANJANA MISHRA ORAL ORDER 11-03-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Baikunthpur P.S. Case No.203 of 2013 for allegedly having committed the offences under Sections 420, 467, 468, 471 and 414 of the Indian Penal Code.

It is submitted on behalf of the petitioner that a Bolero vehicle was stolen, which is alleged to have been recovered from the door of one Naga Singh. However, said Naga Singh has been extended the privilege of regular bail. Learned counsel for the petitioner further submits that only allegation against this petitioner is that from the vehicle in question, some documents were recovered, which contained the name of this petitioner

Patna High Court Cr.Misc. No.41168 of 2014 (3) dt.11-03-2015 2/2 along with affidavit of one purchaser Dhrub Singh. Learned counsel submits that such forged and fabricated document cannot be used to indict the petitioner and as such, he may be extended the privilege of anticipatory bail.

Considering the aforementioned submissions and also the fact that there is no cogent material so as to implicate the petitioner in the present case, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Baikunthpur P.S. Case No.203 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
