JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 The present applications have been filed for confirmation/cancellation of provisional bail of the petitioner Ravindra Rai granted vide order dated 06.08.2013 passed in Cr. Misc. No. 25901 of 2013, whereby the petitioner Ravindra
Patna High Court Cr.Misc. No.41693 of 2014 (4) dt.07-01-2015 2/2 Rai was granted provisional bail for one year. The provisional bail was to be confirmed by learned Court below on substantial restoration of matrimonial harmony or the informant refuses to co-operate in reconciling the issue.
It is submitted by learned counsel for the petitioner Ravindra Rai that informant has performed second marriage. The report to that effect has been called for by learned Court below from the concerned police station but the same has not been received.
It is submitted by learned counsel for the informant that petitioner has adopted a tactic so that the issue could not be resolved.
Considering the fact that petitioner was remained in custody for six months, the order dated 06.08.2013 passed in Cr. Misc. No. 25901 of 2013 is modified to the extent that provisional bail of the petitioner is hereby confirmed in connection with Rajapakar P.S. Case No. 132 of 2010, pending in the Court of learned Sub-Divisional Judicial Magistrate, Vaishali.
Accordingly both the applications are disposed off.
