The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged against the petitioner that he along with co-accused Himanshu Rai and others made had made indiscriminate firing upon the informant and his

Patna High Court CR. MISC. No.19767 of 2022(2) dt.28-09-2022 2/3 brothers namely Bodh Nath Kumar and Abhay Kumar while they were going to attend wedding feast. In this attack, informant's brother namely Abhay Kumar and the informant himself received bullet injuries.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case and in the background of some panchayat election, the present F.I.R has been registered. There is general and omnibus allegation against the petitioner. The specific allegation of opening fire is against coaccused Bhushan Rai and Himanshu Rai. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Maner P.S. Case No.
