JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 30-03-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Bettiah (Muffassil) P.S. Case No. 632 of 2020, registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Informant, Rani Mishra, made allegation that she received a legal notice in which it has been stated that the informant has issued a cheque in favor of the present petitioner for Rs. 9,50,000/- and that cheque was dishonoured by the Bank. Through that notice the petitioner demanded Rs. 9,50,000/- from the informant. The informant has made allegation that she never issued any cheque and

Learned counsel for the petitioner has submitted that the informant has taken loan from the petitioner and she issued a cheque which was dishonoured by the Bank and when he claimed that amount through legal notice she implicated him in false case. The petitioner mentioned details of cheque and account number in the legal notice which was issued in the name of the petitioner by the informant.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah (Muffasil) P.S. Case No. 632 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
