The petitioner seeks regular bail in connection with Dhaka P.S. Case No. 06 of 2020 instituted for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody 28.08.2020, charge-sheet has been submitted in the case and he has got criminal antecedents as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that Satyam Chaudhary @ Surjeon who was apprehended by the police disclosed the name of this petitioner who had fled away after seeing the police force. Further, that a revolver and cartridge was recovered from Satyam

He further submits that since petitioner was not apprehended at the place of occurrence and his name was disclosed by Satyam Chaudhary who has been granted bail vide order dated 19.10.2020 in Cr. Misc. No. 27084 of 2020, the petitioner also deserves to be enlarged on bail. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 28.08.2020, co-accused Satyam Chaudhary @ Surgeon has been granted bail and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dhaka (East Champaran) in connection with Dhaka P.S. Case No. 06 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C. with a condition that one of the bailor shall be the mother of the petitioner and in the event, the petitioner, after trial commences, does not appear on two consecutive dates, the learned court below shall proceed to cancel his bail bonds.
