JUSTICE SANJAY PRIYA ORAL ORDER 12-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Natwar P.S. Case No. 57/2018, instituted for the offences under Sections 411, 414 and 401 of the Indian Penal Code.

It is alleged in the written report that police arrested three persons including the petitioner. On search, one theft mobile was recovered from their possession. Police recorded confessional statement of Golu Kumar who disclosed that he along with petitioner and other has stolen the said mobile. He also disclosed that he along with Arun Kumar and others had also snatched a mobile. On such confession, aforesaid mobile has been recovered from the house of Arun Kumar.

Patna High Court Cr.Misc. No.62235 of 2018 (2) dt.12-10-2018 2/2 Learned counsel for the petitioner has submitted that petitioner along with other accused, namely, Golu Kumar and Manoj Kumar were arrested on suspicion by the police. Seizurelist is part of F.I.R., from which it appears that mobile has been recovered from the house of Arun Kumar. Nothing has been recovered from possession of this petitioner. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IVth, Rohtas at Sasaram in connection with Natwar P.S. Case No. 57/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
