JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 342,323,364,511,307 and 379/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the accused persons snatched the motorcycle of the informant and tried to abduct him when co accused Saheb Paswan resorted to fire but it did not hit any one.. One co accused was apprehended on the spot from whom fire arm and live cartridge were recovered.

It is submitted by the learned counsel for the petitioners that the accusation is not specific against the petitioners and the

Patna High Court Cr.Misc. No.34316 of 2015 (2) dt.25-08-2015 2/2 accusation has been levelled in the background of title suit pending between the parties. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the fact that accusation is not specific against the petitioners, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Koilwar P.S. Case No. 125 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
